1. Introduction

1.1 Elite Service Search LLC., Inc. d/b/a Elite Service Search (“Elite Service Search,” “we,” “us,” or “our”) operates an online marketplace and technology platform accessible through eliteservicesearch.com and related websites, applications, tools, communications, and services (collectively, the “Platform”). The Platform is designed to connect customers, businesses, employers, contractors, service providers, freelancers, professionals, and other users across domestic and international markets.
1.2 Elite Service Search may provide or facilitate access to service listings, professional services, freelance work, contracts, projects, tasks, employment-related postings, business opportunities, communications, ratings, reviews, payment-related services, payout-related services, rewards, and other marketplace functionality.
1.3 These Global Terms and Conditions (“Terms”) govern access to and use of the Platform and all services made available through or in connection with the Platform. By accessing, registering for, browsing, or using the Platform, you agree to be legally bound by these Terms, our Privacy Policy, and any additional terms, policies, rules, or notices incorporated into these Terms.
1.4 If you do not agree to these Terms, you must not access or use the Platform.

2. Acceptance of Terms and Electronic Agreement

2.1 By creating an account, clicking an acceptance button, submitting information, posting a job or service, communicating through the Platform, purchasing a service or subscription, accepting a project, receiving a payment or payout, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to these Terms.
2.2 These Terms constitute an electronic contract. You agree that electronic records, electronic signatures, click-through acceptances, account activity, and electronic communications may be used to establish your agreement to these Terms to the fullest extent permitted by applicable law.
2.3 If you use the Platform on behalf of a company, organization, or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms.

3. Definitions

3.1 “User” means any person, business, organization, employer, freelancer, contractor, service provider, customer, or other entity accessing or using the Platform.
3.2 “Customer” or “Service Seeker” means a person or entity seeking, purchasing, hiring, requesting, or receiving services, projects, tasks, or other work.
3.3 “Contractor,” “Freelancer,” or “Service Provider” means a person or entity offering or performing services, projects, tasks, professional work, or other services through or in connection with the Platform.
3.4 “Employer” means a person or entity posting or seeking candidates for employment, contract, freelance, temporary, or other work opportunities.
3.5 “Job Seeker” means a person seeking employment, freelance work, contract work, projects, gigs, tasks, or other work opportunities.
3.6 “Transaction” means any service engagement, project, task, job, contract, purchase, subscription, payment, payout, refund, credit, reward, or other commercial interaction facilitated through or connected to the Platform.
3.7 “Global Payout” means a payout, withdrawal, transfer, or other disbursement made to an eligible User through an available payment or payout method, subject to verification, eligibility, fees, currency conversion, applicable law, and the rules of the applicable payment provider.
3.8 “Payment Provider” means a third-party bank, payment processor, electronic money institution, payout provider, card network, financial institution, or other provider used to process payments or payouts.
3.9 “User Content” means any profile, resume, listing, service description, photograph, video, text, message, review, rating, document, logo, portfolio, proposal, or other material submitted to or displayed through the Platform.

4. Description of the Global Platform

4.1 Elite Service Search provides technology and marketplace services that may connect Users across countries and regions. The Platform may support local services, remote services, international freelance services, global professional services, contract work, short-term projects, gigs, tasks, job opportunities, business services, and other categories made available from time to time.
4.2 Elite Service Search is generally a marketplace and technology intermediary. Unless expressly stated otherwise in a separate written agreement, Elite Service Search is not the employer, customer, contractor, freelancer, service provider, agent, broker, insurer, guarantor, or legal representative of any User.
4.3 Elite Service Search does not guarantee that any User will find work, receive work, complete a transaction, be hired, be paid, receive a payout, or achieve any particular result.
4.4 Features, service categories, geographic availability, payment methods, payout methods, currencies, fees, limits, and eligibility requirements may vary by country, region, account type, transaction type, and applicable law.

5. Eligibility, Registration, and Accounts

5.1 Users must provide accurate, current, and complete information and must promptly update information that becomes inaccurate.
5.2 Users are responsible for maintaining the confidentiality of account credentials and for all activity conducted through their accounts.
5.3 Accounts may not be sold, assigned, transferred, rented, or shared without Elite Service Search’s prior written authorization.
5.4 Elite Service Search may require identity verification, business verification, age verification, tax information, payment verification, address verification, sanctions screening, fraud screening, or other information before allowing access to certain features or transactions.
5.5 Elite Service Search may refuse registration, restrict features, place an account on hold, suspend, or terminate an account where information cannot be verified or where we reasonably believe an account presents legal, financial, security, fraud, compliance, or safety risk.

6. Global Freelancers, Contractors, and Service Providers

6.1 Freelancers, Contractors, and Service Providers are responsible for accurately describing their qualifications, experience, services, location, availability, pricing, licenses, certifications, and ability to perform the services offered.
6.2 A Freelancer or Service Provider is solely responsible for determining whether it is legally permitted to provide services to a customer located in another country or jurisdiction.
6.3 Users are solely responsible for obtaining and maintaining all licenses, registrations, permits, insurance, work authorizations, visas, professional credentials, tax registrations, and other approvals required for their activities.
6.4 Elite Service Search does not guarantee the quality, legality, availability, skill, qualifications, licensing, insurance, identity, or performance of any Freelancer, Contractor, or Service Provider.
6.5 Unless expressly agreed in writing, Elite Service Search does not create an employment relationship between Elite Service Search and any Freelancer, Contractor, Service Provider, Customer, or other User.

7. Global Services and International Transactions

7.1 Users may be located in different countries and may be subject to different laws, regulations, taxes, consumer-protection rules, employment rules, payment rules, data-protection rules, and licensing requirements.
7.2 Each User is solely responsible for determining and complying with the laws applicable to that User, the User’s location, the other party’s location, the location where services are performed, and the nature of the Transaction.
7.3 Elite Service Search does not guarantee that a particular service, project, job, payment, payout, or Transaction is legally available in every country or jurisdiction.
7.4 Elite Service Search may restrict, suspend, or refuse Transactions involving certain countries, territories, persons, entities, industries, goods, services, or activities when required or deemed appropriate for legal, regulatory, sanctions, fraud, security, or business reasons.
7.5 Users must not use the Platform to evade sanctions, export controls, trade restrictions, anti-money-laundering requirements, tax laws, immigration laws, employment laws, or other applicable legal requirements.

8. Payments, Fees, and Third-Party Payment Providers

8.1 Payments may be processed by Elite Service Search or by third-party Payment Providers. Payment processing may be subject to separate terms and privacy policies of those providers.
8.2 Users authorize Elite Service Search and applicable Payment Providers to process authorized charges, payments, fees, refunds, adjustments, reversals, and payouts in accordance with the applicable Transaction.
8.3 Prices, fees, subscriptions, commissions, service charges, processing fees, currency-conversion costs, payout fees, taxes, and other charges may be disclosed at checkout, within an account, in a service agreement, or elsewhere on the Platform.
8.4 Elite Service Search may change fees, pricing, subscription charges, payout fees, or other charges prospectively. Continued use of the affected service after notice may constitute acceptance of the revised charges.
8.5 A User is responsible for ensuring that payment information is accurate and that the User is authorized to use the payment method.
8.6 Elite Service Search may delay, hold, reserve, offset, reverse, or otherwise restrict funds where reasonably necessary to investigate fraud, chargebacks, disputes, suspected unlawful activity, account compromise, payment errors, identity concerns, sanctions concerns, or other risk.

9. Global Payouts and Withdrawals

9.1 Where available, eligible Freelancers, Contractors, Service Providers, and other Users may request a Global Payout through available payout methods.
9.2 Global Payout availability is not guaranteed and may depend on country, region, currency, account status, identity verification, tax information, payment-provider availability, transaction history, risk review, applicable law, and other eligibility requirements.
9.3 Elite Service Search may require identity verification, beneficial-owner information, tax information, payment-account verification, or other documentation before processing or releasing a payout.
9.4 Payouts may be made in a currency different from the currency in which funds were earned or charged. Currency conversion may be performed by Elite Service Search or a Payment Provider. Exchange rates and conversion fees may affect the amount received.
9.5 The amount received by a User may be reduced by applicable platform fees, payout fees, payment-processing fees, currency-conversion fees, bank charges, intermediary-bank charges, taxes, withholding, government fees, or other deductions.
9.6 Payout timing is an estimate and is not a guarantee. Payouts may be delayed by weekends, holidays, banking systems, payment-provider processing, compliance review, fraud review, identity verification, technical issues, incorrect payout information, or events outside Elite Service Search’s control.
9.7 Users are responsible for providing accurate payout information. Elite Service Search is not responsible for losses caused by incorrect, incomplete, outdated, or unauthorized payout information supplied by a User.
9.8 Elite Service Search may place a temporary hold on payouts where reasonably necessary to investigate a dispute, chargeback, fraud allegation, policy violation, legal requirement, or other risk.
9.9 Users are solely responsible for all taxes, reporting, filings, withholding obligations, social contributions, business obligations, and other governmental obligations associated with money earned or received through the Platform, except to the extent Elite Service Search is legally required to withhold or report amounts.
9.10 Elite Service Search may impose minimum payout thresholds, maximum payout limits, rolling reserves, transaction limits, or other risk controls. These may vary by User, country, currency, account type, payment method, and applicable law.

10. Refunds, Cancellations, Chargebacks, and Payment Disputes

10.1 Refunds are governed by the applicable Transaction terms, service terms, subscription terms, and this Section. Because Transactions may involve different services, currencies, countries, and Payment Providers, refund eligibility may vary.
10.2 Unless otherwise expressly stated, fees for completed services, completed digital services, completed freelance work, completed projects, consumed services, and services already made available are generally non-refundable except where required by applicable law or where Elite Service Search expressly approves a refund.
10.3 A request for a refund should be submitted through the designated customer-support channel as soon as reasonably possible and should include relevant information and supporting documentation.
10.4 Elite Service Search may review refund requests based on the nature of the Transaction, service status, cancellation timing, evidence submitted, applicable law, payment-provider rules, fraud indicators, and the conduct of the parties.
10.5 Approved refunds may be issued to the original payment method where reasonably possible. Refund timing may depend on the applicable Payment Provider and financial institution.
10.6 Refunds may be reduced by non-refundable third-party charges, currency-conversion differences, processing fees, or other amounts where permitted by applicable law and disclosed or reasonably applicable to the Transaction.
10.7 If a User initiates a chargeback, payment reversal, bank dispute, or unauthorized-payment claim without first contacting Elite Service Search when the dispute concerns an Elite Service Search Transaction, Elite Service Search may suspend or restrict the account, place funds on hold, provide relevant Transaction information to the Payment Provider, and seek recovery of amounts properly owed.
10.8 Nothing in this Section limits rights that cannot lawfully be waived under applicable consumer-protection or other mandatory laws.
10.9 Elite Service Search may update refund procedures and specific refund rules for particular products, subscriptions, service categories, or Transactions. Where specific terms conflict with this Section, the specific terms will control for that Transaction unless prohibited by law.

Cancellations of Paid Business Memberships
Users of the website that pay for membership (paying businesses) are entitled to contact, and offer quotes to, other website users who have submitted a job listing on the website matching the paying business’ industry and geographic settings.

Paying businesses can cancel future payments for their membership at any time by visiting eliteservicesearch.com while logged in to their account.

Paying businesses must click Cancel and select a reason for canceling their Membership. They will be able to access all the features of their Membership up until the expiry date shown on eliteservicesearch.com

If a paying business attempts to cancel online but cannot complete the cancellation, they may contact support at email contact@eliteservicesearch.com. and clearly state they wish to cancel their membership. This email must be received by the support team at least 2 business days before the next billing date indicated on the paying business account. Communication received closer to the next billing date will be processed after the next billing date shown on the account.

Paying businesses that have prepaid for any length of time will not be refunded for the unused portion of their membership by the Refunds Policy.

11. User Responsibilities and Prohibited Conduct

11.1 Users must comply with applicable laws, regulations, these Terms, and all applicable Platform policies.
11.2 Users must not use the Platform for fraud, scams, money laundering, terrorist financing, sanctions evasion, identity theft, payment abuse, illegal goods or services, or any unlawful activity.
11.3 Users must not impersonate another person or entity, create false identities, misrepresent qualifications, manipulate reviews, submit fraudulent invoices, falsify documents, or misrepresent work performed or received.
11.4 Users must not upload malware, viruses, harmful code, or materials designed to interfere with the Platform or another User’s systems.
11.5 Users must not scrape, crawl, harvest, copy, reverse engineer, automate, overload, or misuse the Platform or its data without prior written authorization.
11.6 Users must not solicit passwords, payment credentials, private information, or sensitive personal information from other Users.
11.7 Users must not use the Platform to harass, threaten, stalk, bully, defame, discriminate against, exploit, or intimidate any person.
11.8 Users must not post or transmit unlawful, obscene, sexually explicit, exploitative, hateful, threatening, violent, discriminatory, defamatory, infringing, or otherwise objectionable content.
11.9 Users must not use the Platform to recruit for unlawful schemes, pyramid schemes, fraudulent investment schemes, deceptive business opportunities, or other prohibited activities.
11.10 Elite Service Search may remove content, restrict features, suspend accounts, terminate accounts, withhold or delay funds where permitted, and cooperate with authorities when we reasonably believe these Terms or applicable law may have been violated.

12. Jobs, Employment, Freelance Projects, Gigs, and Tasks

12.1 Job postings, project postings, gig postings, and task postings are generally created by third parties. Elite Service Search does not guarantee that any posting is accurate, lawful, current, available, or legitimate.
12.2 Employers and customers are solely responsible for their postings, hiring decisions, work arrangements, classification decisions, and compliance with applicable labor, employment, tax, immigration, privacy, anti-discrimination, and other laws.
12.3 Freelancers, Contractors, and Job Seekers are solely responsible for evaluating opportunities and determining whether to accept them.
12.4 Users must not post opportunities that are illegal, fraudulent, misleading, discriminatory, exploitative, sexually exploitative, or otherwise prohibited by applicable law or these Terms.
12.5 Elite Service Search is not responsible for employment decisions, hiring decisions, compensation decisions, classification decisions, workplace conditions, or the conduct of an Employer, Customer, Freelancer, Contractor, or Service Provider.

13. Identity Verification, Background Checks, and Trust Features

13.1 Elite Service Search may use third-party providers to conduct identity verification, business verification, document verification, background checks, fraud screening, sanctions screening, or other trust and safety checks.
13.2 Verification does not guarantee a User’s identity, qualifications, honesty, safety, legality, or future conduct.
13.3 Users must provide truthful information and must not submit altered, fraudulent, stolen, or misleading documents.
13.4 Elite Service Search may deny, delay, restrict, or terminate access based on verification results or inability to complete verification.

14. User Content and Intellectual Property

14.1 Users retain ownership of User Content to the extent they own the applicable rights.
14.2 By submitting User Content, the User grants Elite Service Search a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, format, display, distribute, adapt, modify, translate, promote, and otherwise use the User Content as reasonably necessary to operate, improve, market, secure, and provide the Platform.
14.3 Users represent that they have all rights and permissions necessary to submit and license User Content.
14.4 Elite Service Search may remove or restrict User Content that violates these Terms, applicable law, third-party rights, or Platform policies.
14.5 Elite Service Search owns or licenses the Platform, software, trademarks, logos, designs, systems, databases, and other proprietary materials used to operate the Platform. Except as expressly permitted, Users may not copy, modify, distribute, sell, reverse engineer, or exploit them.

15. Reviews, Ratings, Testimonials, and Feedback

15.1 Users may be permitted to submit ratings, reviews, testimonials, and feedback based on genuine experiences.
15.2 Reviews and ratings must be truthful, based on actual experience, and must not be manipulated, purchased, exchanged for improper benefits, fabricated, or posted by persons who did not experience the applicable service.
15.3 Elite Service Search may remove, restrict, or moderate content that violates law, these Terms, review policies, or the rights or safety of others.
15.4 Elite Service Search does not guarantee the accuracy or reliability of any review, rating, testimonial, or User opinion.

16. Privacy and Data Protection

16.1 The Privacy Policy explains how Elite Service Search collects, uses, stores, shares, and protects personal information.The Website's privacy policy, available at https://eliteservicesearch.com/privacy-policy. By using the Website, you consent to the collection and use of your information as described in the privacy policy.
16.2 Users may be located in different countries. Personal information may be processed or transferred across borders where permitted by applicable law and subject to applicable safeguards.
16.3 Users must not misuse, sell, disclose, or unlawfully process personal information obtained through the Platform.
16.4 Users are responsible for complying with applicable data-protection obligations when processing information obtained through the Platform.

17. Third-Party Services and External Websites

17.1 The Platform may integrate with or link to third-party websites, payment services, communication services, identity-verification services, cloud services, and other providers.
17.2 Elite Service Search does not control third-party services and is not responsible for their availability, content, security, policies, acts, omissions, or performance.
17.3 Use of third-party services may be subject to separate terms and privacy policies.

18. Suspension, Holds, and Termination

18.1 Elite Service Search may suspend, restrict, place on hold, or terminate an account or access to any part of the Platform if we reasonably believe a User has violated these Terms, applicable law, payment-provider rules, security requirements, or risk controls.
18.2 Elite Service Search may also take action where necessary to protect Users, the Platform, payment systems, third parties, or the public.
18.3 Termination may result in loss of access to account information, listings, messages, profiles, stored data, or other content, subject to applicable law and our retention obligations.
18.4 Provisions that by their nature should survive termination will survive, including payment obligations, intellectual-property rights, disclaimers, indemnification, limitations of liability, dispute-resolution provisions, and governing-law provisions.

19. Disclaimers

19.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
19.2 ELITE SERVICE SEARCH DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, COMPLETE, CURRENT, OR AVAILABLE IN EVERY LOCATION.
19.3 ELITE SERVICE SEARCH DOES NOT GUARANTEE THE IDENTITY, QUALIFICATIONS, SAFETY, LEGALITY, QUALITY, TIMELINESS, AVAILABILITY, OR PERFORMANCE OF ANY USER, SERVICE, JOB, PROJECT, TASK, OR TRANSACTION.
19.4 USERS ARE RESPONSIBLE FOR THEIR OWN DUE DILIGENCE AND DECISIONS. USERS SHOULD OBTAIN INDEPENDENT PROFESSIONAL, LEGAL, TAX, FINANCIAL, EMPLOYMENT, OR OTHER ADVICE WHEN APPROPRIATE.

20. Limitation of Liability

20.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE SERVICE SEARCH AND ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO THE PLATFORM OR THESE TERMS.
20.2 TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF ELITE SERVICE SEARCH ARISING OUT OF OR RELATED TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID DIRECTLY TO ELITE SERVICE SEARCH FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
20.3 Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

21. Indemnification

21.1 You agree to defend, indemnify, and hold harmless Elite Service Search and its owners, directors, officers, employees, agents, contractors, affiliates, licensors, and service providers from claims, liabilities, damages, losses, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to: (a) your use of the Platform; (b) your breach of these Terms; (c) your User Content; (d) your violation of law or third-party rights; (e) your Transactions; or (f) your conduct toward another User.

22. No Agency, Partnership, or Employment Relationship

22.1 These Terms do not create an agency, partnership, joint venture, employment, franchise, fiduciary, or other similar relationship between Elite Service Search and any User.
22.2 Unless expressly agreed in a separate written agreement, Elite Service Search does not employ, supervise, control, or direct the work of any Freelancer, Contractor, Service Provider, Employer, or other User.

23. Dispute Resolution

23.1 Users should first contact Elite Service Search at contact@eliteservicesearch.com to attempt to resolve disputes concerning the Platform.
23.2 Disputes between Users concerning the actual performance, quality, payment, safety, legality, or outcome of services are primarily disputes between those Users. Elite Service Search may, but is not obligated to, assist with communications or dispute resolution.
23.3 Except where prohibited by applicable law or otherwise required by law, any dispute arising out of or relating to these Terms or the Platform may, at Elite Service Search’s election, be resolved through binding arbitration administered by a recognized commercial dispute-resolution provider.
23.4 Where legally permitted, disputes must be brought on an individual basis and not as a class, collective, or representative action. This provision does not apply where such waiver is prohibited by applicable law.
23.5 The governing law, arbitration location, and procedural rules should be finalized by Elite Service Search’s legal counsel to ensure consistency with the company’s legal entity and applicable consumer laws.

24. Governing Law and Jurisdiction

24.1 Unless otherwise required by mandatory applicable law, these Terms will be governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles.
24.2 Any court proceeding permitted under these Terms will be brought in a court of competent jurisdiction selected in accordance with applicable law.
24.3 Mandatory consumer, employment, privacy, payment, and other legal rights in a User’s country or jurisdiction are not waived where such waiver is prohibited by law.

25. Taxes and Governmental Obligations

25.1 Users are responsible for determining and paying all taxes and governmental charges arising from their use of the Platform or money earned or received through the Platform.
25.2 Elite Service Search may collect, report, withhold, or remit amounts when required by law.
25.3 Users must provide accurate tax or governmental information when requested.

26. Electronic Communications and Recordings

26.1 Users consent to receive electronic communications regarding accounts, Transactions, security, payments, payouts, Platform updates, and customer support.
26.2 Where permitted by law, calls or communications with Elite Service Search may be recorded or monitored for training, quality, security, fraud prevention, and compliance purposes.

27. Customer Support and Complaints

27.1 Customer support inquiries may be submitted to contact@eliteservicesearch.com.
27.2 Elite Service Search will make reasonable efforts to review complaints and support requests, but response times are not guaranteed and may vary based on complexity, volume, location, language, and third-party involvement.
27.3 Users must provide accurate information and reasonable cooperation when requesting assistance.

Customer Support Policy
We make a considerable investment in staff and technology to help answer customer inquiries. Our staff will endeavor to handle inquiries from registered users of the website according to the following policy:

We will attempt to respond to email inquiries within 1 business day of the first contact made by a customer by email to contact@eliteservicesearch.com
All inquiries are logged and managed by the Elite Service Search Customer Relationship Management software.
Technical or product development suggestions may be considered for future software upgrades. Your suggestions may not result in changes to the software or our business practices.
All other inquiries are reviewed by our customer support representatives and may be escalated to a manager for resolution if required.
We reserve the right not to respond to customer inquiries that offend our employees or agents.
We reserve the right not to respond to inquiries made by individuals who, in our opinion, are not current users of the website, or have been suspended from using the website.

28. Changes to the Platform and Terms

28.1 Elite Service Search may modify, suspend, discontinue, or restrict any feature, service, category, payment method, payout method, geographic availability, or other aspect of the Platform.
28.2 Elite Service Search may update these Terms from time to time. Updated Terms become effective when posted or on the date specified in the updated Terms.
28.3 Where required by law, Elite Service Search will provide additional notice of material changes.
28.4 Continued use of the Platform after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.

29. Severability, Waiver, and Entire Agreement

29.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
29.2 Failure to enforce any provision is not a waiver of the right to enforce it later.
29.3 These Terms, together with applicable policies and additional terms incorporated by reference, constitute the agreement between you and Elite Service Search concerning the Platform, except where a separate written agreement expressly applies.

This Cash Back Program Addendum supplements the Global Terms and Conditions. If there is a conflict, the specific terms of this Addendum control the Cash Back Program unless prohibited by applicable law. Cashback Rewards Program: Available only for U.S. local services.
Not eligible: International Freelancers, Quick Tasks, or Quick Gigs.

1. Eligibility

1.1 Eligibility, reward rates, limits, eligible transactions, and program availability are determined by Elite Service Search and may vary by country, region, account type, and applicable law.
1.2 Elite Service Search may restrict participation where required by law, payment-provider rules, fraud controls, tax requirements, or other compliance considerations.
1.3 Customers of Elite Service Search are eligible to participate in the Elite Cash Back Rewards Program.
1.4 The specific percentage and annual amount of cash-back rewards are detailed on the Elite Service Search website and are subject to change at the discretion of Elite Service Search.

2. Calculation and Submission

2.1 Cash-back rewards, if offered, are calculated according to the program rules displayed on the Platform at the time of the eligible Transaction.
2.2 Cash back rewards are calculated based on a percentage of the total invoice amount submitted through the Elite Service Search platform. Earn up to 5% cash back on every service request completed through the Elite Service Search platform.
2.3 Elite Service Search may require proof of a genuine completed Transaction, invoice, receipt, service completion, or other documentation.
2.4 The invoice submitted by the customer through the Elite Service Search platform must be from completed projects or services received by Elite Contractors or Service Providers. Customers must submit their invoice within 30 days of service completion to be eligible for cashback.
2.5 The annual cash-back amount a customer can receive is capped as specified on the Elite Service Search website. Customers can earn up to $100 per month, with a maximum of $1,200 per year in rewards.
2.6 Invoices up to $6,000 are eligible; invoices exceeding this amount will not be accepted.
2.7 Transactions that are refunded, reversed, charged back, fraudulent, disputed, canceled, or otherwise ineligible may not qualify for cash back.

3. Payout and Withdrawal

3.1 Cash-back rewards may be subject to minimum withdrawal thresholds, maximum monthly or annual limits, verification requirements, payout fees, currency conversion, taxes, and applicable payment-provider rules.
3.2 Customers may only withdraw their accumulated cash-back rewards once they reach a minimum threshold, which is also specified on the EliteServiceSearch website. The minimum threshold for withdrawal is $100. Customers can earn up to $100 per month, with a maximum of $1,200 per year in rewards.
3.3 Customers must link their bank account information to withdraw their accumulated cash-back rewards once they reach a minimum threshold.
3.4 Elite Service Search reserves the right to adjust this minimum threshold at any time.

4. Program Changes and Misuse

4.1 Elite Service Search may modify, suspend, or terminate the program, subject to applicable law.
4.2 Fraud, duplicate accounts, fabricated invoices, manipulation, self-referrals, collusion, or other misuse may result in forfeiture of rewards, account suspension, termination, and recovery of improperly obtained amounts.
4.3 Elite Service Search may investigate suspected misuse and may delay or hold rewards during an investigation.

5. No Guaranteed Value

5.1 Cash-back rewards are promotional benefits and are not guaranteed unless the User satisfies all applicable program requirements.
5.2 Elite Service Search is not responsible for losses caused by inaccurate information submitted by a User, incorrect banking information, third-party payment-provider delays, currency fluctuations, or events outside Elite Service Search’s reasonable control, except where liability cannot legally be excluded.

By participating in the Elite Cash Back Rewards Program, customers agree to abide by the terms and conditions outlined in this Addendum and the overall Terms and Conditions of the Elite Service Search platform.
